COVID-19 Update: Contractual Best Practice

Dear Members, 

As uncertainty continues to affect building sites and projects in these unprecedented circumstances, new approaches to resolving or avoiding potential disputes are required. The government and the Construction Leadership Council (CLC) have now published detailed guidance on ways in which standard practice can be amended in order to support contract completion and a rapid recovery from the impacts of COVID-19.

Both the CLC guidance (para 6.17) and guidance issues by the Cabinet Office (para 17) guidance refers to the CIC Low Value Dispute Model Adjudication Procedure (CIC LVD MAP) which was launched last Friday and which offers a new route to dispute resolution for smaller value works. 

The following links provide full guidance as well as detailed sample letters, and we recommend CABE members look closely at the guidance provided – in the words of the CLC: 


"We believe that these same principles must be reflected across the whole of the industry for it to survive for the long-term."
